Acceptable Use & Privacy Policy

This Acceptable Use Policy ("Policy") governs your use of Delicate Courier’s platforms, services, APIs, and related systems (collectively, "Services"). By accessing or using our Services, you agree to comply with this Policy.
Delicate Courier’s platforms must only be used for their intended purpose as described in our documentation and service agreements.

You may not engage in any activity that misuses, abuses, or interferes with our Services. Prohibited activities include, but are not limited to:

• Scraping, mining, or crawling data from our Services using automated tools, bots, or scripts
   
• Automated enumeration of IDs or systematic discovery of resources not explicitly provided to you
   
• Reverse engineering our Services, APIs, or software to discover underlying implementations or algorithms
   
• Caching or republishing data obtained from our Services without explicit written permission
   
• Circumventing rate limits or security controls through technical means or multiple accounts
   
• Degrading service performance through excessive requests, resource consumption, or denial-of-service attacks
   
• Bypassing authentication or authorization mechanisms, or accessing resources you are not entitled to
   
• Sharing or reselling access to our Services without authorization
   
• Using our Services for any unlawful purpose or in violation of applicable laws and regulations
   

To maintain the security, stability, and integrity of our Services, Delicate Courier may implement protective measures without prior notice, including but not limited to:

• Rate limiting and throttling of requests
   
• Bot detection and challenge mechanisms (e.g., CAPTCHA)
   
• IP address and ASN (Autonomous System Number) blocking
   
• Session binding and validation
   
• Rotating tokens and credentials
   
• Request fingerprinting and anomaly detection
   
• Geographic or network-based access restrictions
   
• Other technical controls as deemed necessary
   

These measures are designed to protect our Services and all users. Circumventing or attempting to bypass these protections is strictly prohibited.

Delicate Courier reserves the right to monitor use of our Services to ensure compliance with this Policy. We may:

• Log and analyse access patterns, API calls, and system interactions
   
• Investigate suspicious or anomalous activity
   
• Suspend or block access immediately if we detect violations or abusive behaviour
   
• Terminate accounts that engage in prohibited activities
   
• Pursue legal remedies for violations, including claims for damages and injunctive relief
   

We may take these actions without prior notice if necessary to protect our Services, infrastructure, or other users.

You may not collect, store, or disclose personal information obtained from Delicate Courier Services without a lawful basis under the Protection of Personal Information Act (POPIA) and other applicable data protection laws.

Specifically, you must not:

• Extract personal information for purposes other than those for which access was granted
   
• Share, sell, or transfer personal information to third parties without proper legal authority
   
• Use personal information in a manner inconsistent with our privacy policies or applicable law
   
• Retain personal information longer than necessary for legitimate purposes
   

Violations of data protection requirements may result in immediate termination of access and legal action.

Users who misuse our Services are responsible for all losses, damages, and costs arising from their prohibited use, including but not limited to:

• System degradation and performance impacts
   
• Incident response and investigation costs
   
• Security remediation expenses
   
• Legal fees and litigation costs
   
• Reputational harm and business losses
   
• Third-party claims resulting from your actions
   

By using our Services, you agree to indemnify and hold harmless Delicate Courier (Pty) Ltd, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of this Policy.

Delicate Courier may update this Policy, modify usage limits, revoke access, or implement additional restrictions at any time without prior notice. Continued use of our Services after changes constitutes acceptance of the updated Policy.
We may also adjust rate limits, API quotas, and access permissions based on usage patterns, system capacity, and security considerations.

Delicate Courier reserves the right to pursue all available legal remedies for violations of this Policy, including but not limited to:

• Civil claims for breach of contract, damages, and injunctive relief
   
• Criminal complaints under the Cybercrimes Act, 2020 (South Africa) and other applicable laws
   
• Reporting to law enforcement and regulatory authorities
   
• Cooperation with investigations by authorities in any jurisdiction
   

Violations may constitute criminal offences under South African law, including unauthorised access to computer systems, data theft, and fraud.
